The Treasure Valley and Regional Air Quality Act

The Treasure Valley and Regional Air Quality Act was created when Senate Bill 1142 passed in March, 2005, by the Idaho Senate (31-0, 3 absent) and House (53-15, 2 absent), and was signed by then-governor Dirk Kempthorne.  The act created the Treasure Valley Air Quality Council with the 14 members appointed November 4, 2005, by then-governor Dirk Kempthorne.

Responsibilities of the council as stated in the Treasure Valley and Regional Air Quality Act

  • Coordinate the compilation of all historical studies of air quality that have been conducted in the Treasure Valley.
  • Examine the air quality conditions in and around the Treasure Valley with the objective being to obtain a scientifically-sound baseline study for planning future action(s) by federal, state and local government, and the private sectors.
  • Consult with the public and keep the public informed of activities of the council through public forums and written reports.   Establish a non-voting citizens committee.
  • Develop an air quality plan for the area and assist in implementation of that plan.
  • Conduct a public awareness campaign to educate the public on methods and responsibilities to protect the airshed.
  • Recommend, as appropriate, the adoption of statutes, ordinances, policies and rules needed by governmental agencies to implement the plan.
  • Perform these duties continuously until dissolution.
  • Prior to the automatic dissolution of the council within seven years of the plan being adopted by the legislature, assist local, state and federal agencies in the establishment of a multi-agency oversight capability to succeed the council.
